These Terms and Conditions set out the basis on which Rubbish Removal Clapham provides rubbish removal and related waste collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions the following expressions have the meanings set out below.
Customer means the person, company or organisation requesting the service.
We, us, our means Rubbish Removal Clapham, the service provider.
Service means any rubbish removal, waste collection, clearance, loading, transportation, or disposal work we undertake for you.
Site means the property, premises or location from which we are instructed to remove waste or provide related services.
Waste means the items, materials and rubbish you request us to remove, excluding any items which are prohibited by law or by these Terms and Conditions.
2. Scope of Service
We provide a rubbish removal and waste collection service which typically includes loading items onto our vehicle, transporting them away from the Site, and arranging for lawful disposal, reuse or recycling.
The Service is limited to the items and quantities agreed at the time of booking or as subsequently agreed on Site. We may at our sole discretion refuse to remove any item that is unsafe to handle, not as described at the time of booking, or falls within a prohibited waste category.
We do not provide building, demolition or structural alteration services and will not carry out work that risks damage to the fabric of any building or to utility installations.
3. Booking Process
Bookings may be made by telephone, email or through any booking facility we operate. When you make a booking, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.
You must provide accurate information about the type, quantity and location of the waste, access conditions at the Site, and any relevant restrictions such as parking, loading times, or building regulations. The price we quote will be based on the information you provide.
Where the actual waste, access or Site conditions differ materially from the information given at the time of booking, we reserve the right to revise our price, alter the Service, or decline to proceed. If we attend the Site and are unable to carry out the Service due to inaccurate information or circumstances within your control, a call-out or cancellation fee may apply.
Your booking is accepted when we confirm it verbally or in writing. We reserve the right to refuse or cancel any booking at our discretion, including where we believe the Service may be unsafe, unlawful, uneconomical, or outside our normal operating area.
4. Pricing and Quotations
Prices are generally based on the volume, weight, type of waste and the time required to complete the Service. We may provide an estimated price in advance and confirm the final price upon arrival and inspection of the waste at the Site.
Any quotation is given on the understanding that it is based on the information supplied by you. If the actual waste, access, or working conditions differ, we may adjust the price accordingly. Where we identify additional charges, we will explain these to you before proceeding.
Unless otherwise stated, all prices are quoted in pounds sterling and inclusive or exclusive of VAT as specified at the time of booking. Any parking charges, tolls, fines or similar costs incurred while carrying out the Service due to circumstances at or around the Site may be added to the final invoice.
5. Payments
Payment is due in full on completion of the Service unless alternative arrangements have been agreed in advance in writing. We may require a deposit or full prepayment to confirm your booking, particularly for larger or commercial collections.
We accept payment by cash, card, bank transfer or other payment methods we may specify from time to time. Where payment is made by card, you authorise us to charge the agreed amount and any additional agreed charges.
For account customers and commercial clients with invoicing arrangements, payment terms will be specified on the invoice. If no terms are specified, payment is due within 14 days of the invoice date.
We reserve the right to charge interest on overdue amounts at the statutory rate applicable to commercial debts, together with reasonable costs of recovery. We may suspend or cancel further Services until all outstanding sums have been paid in full.
6. Cancellations and Amendments
You may cancel or amend your booking by contacting us directly. Where possible, we ask for at least 24 hours notice prior to the scheduled attendance time.
If you cancel a booking with more than 24 hours notice, any prepayment made will normally be refunded, subject to the deduction of any non-recoverable costs incurred by us in preparing to deliver the Service.
If you cancel within 24 hours of the scheduled attendance time, fail to provide access, or we are unable to complete the Service due to circumstances within your control, we may charge a cancellation or call-out fee to cover our costs. This may be up to the full quoted price where we have incurred substantial time or travel costs.
We may cancel or reschedule a booking if we are unable to provide the Service due to circumstances beyond our reasonable control, including but not limited to severe weather, traffic incidents, vehicle breakdowns, staff illness, or legal restrictions. In such cases we will endeavour to notify you as soon as reasonably practicable and offer a new appointment. We will not be liable for any loss arising from such cancellation or rescheduling, other than refunding any prepayment for Services not delivered.
7. Access, Parking and Customer Obligations
You must ensure that we have safe and reasonable access to the Site and to the waste to be removed. This includes arranging any necessary permissions from property owners, managing entry systems or security, and ensuring that driveways, corridors, lifts and stairways are clear and usable.
You are responsible for providing suitable parking or loading space as near as reasonably possible to the Site. If free parking is not available, you agree that we may add any parking charges to the final bill. If our vehicle receives a penalty charge notice or similar fine as a result of instructions or restrictions at the Site, we may recharge this to you.
You must ensure that the Site is reasonably safe and that any known hazards are disclosed to us before we start work. We may decline to proceed or suspend the Service if we consider that health and safety standards are not satisfied.
You are responsible for ensuring that all waste you ask us to remove is your property or that you have full authority to dispose of it. You agree to indemnify us against any claims or losses that arise due to your lack of authority over the items removed.
8. Prohibited and Hazardous Waste
We operate in compliance with UK waste regulations and may not be able to remove certain types of waste, including but not limited to asbestos, clinical or medical waste, chemicals, oils, gas bottles, hazardous substances, pressurised containers, and certain electrical or electronic equipment.
You must inform us in advance of any potentially hazardous or regulated materials. If we arrive on Site and identify prohibited or unsafe items, we may refuse to remove them and may charge a reasonable attendance fee.
If hazardous or prohibited waste is loaded onto our vehicle without our prior knowledge or consent, you will be responsible for any costs, fines or liabilities arising from its handling, transport or disposal, and we may return such waste to you.
9. Waste Handling and Environmental Compliance
We are committed to lawful and responsible waste management. All waste collected by us will be transported and disposed of only at authorised facilities, with due regard to the waste hierarchy of reduce, reuse, recycle and recover, where reasonably practicable.
Once waste has been loaded onto our vehicle and payment has been made or agreed, title in the waste transfers to us. We will then determine the most appropriate disposal, reuse or recycling route in accordance with applicable laws and our environmental policies.
We will not be responsible for any items left on Site that were not clearly identified and agreed to be removed. You are advised to separate and clearly indicate the items you wish us to take away and to ensure that you have not included items of value, personal documents or items you intend to keep.
10. Damage and Liability
We will exercise reasonable care and skill when providing the Service. However, minor scuffs or marks may occur when removing bulky items from confined spaces, particularly where access is restricted. We will not be liable for cosmetic damage to walls, floors, door frames or fixtures that is reasonably incidental to the Service, unless caused by our negligence.
You should take reasonable steps to protect floors, carpets and surfaces, and to remove or secure delicate items that may be at risk during the clearance process. If you have particular concerns, you must raise them with our team before work begins.
Our total liability to you for any loss or damage arising out of or in connection with the Service, whether in contract, tort including negligence or otherwise, shall be limited to the total price paid or payable for the relevant Service, except in cases of death or personal injury caused by our negligence, fraud or any other liability that cannot be excluded under UK law.
We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or loss of data, arising from or in connection with the Service.
11. Insurance
We maintain appropriate public liability and, where applicable, employer liability insurance for the nature of our work. Details of our insurance cover are available on request.
It is your responsibility to ensure that you have adequate insurance in place for your property and possessions. We do not provide insurance cover for items that you retain at the Site.
12. Complaints and Disputes
If you are dissatisfied with any aspect of the Service, you should raise the issue with our team as soon as possible, preferably while they are still on Site, so that we have an opportunity to address your concerns immediately.
If the matter is not resolved to your satisfaction, you may submit a formal complaint by contacting our office with full details of the issue, including the date of Service and any supporting information. We will investigate and respond within a reasonable time frame.
We will endeavour to resolve disputes amicably. If a dispute cannot be resolved informally, you and we may agree to refer the matter to mediation or another form of alternative dispute resolution before commencing court proceedings, where appropriate.
13. Data Protection and Privacy
We collect and use personal data such as your name, contact details, address and payment information for the purposes of providing the Service, managing bookings, processing payments and communicating with you.
We will handle your personal data in accordance with applicable UK data protection laws. We will not sell your personal information to third parties. We may share information with trusted partners where necessary to deliver the Service, comply with legal obligations or protect our legitimate interests.
14. Variations to these Terms
We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking. Any changes will normally be published on our standard documentation or made available upon request.
No variation to these Terms and Conditions will be binding unless agreed by us in writing.
15. Severability
If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable.
16. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service provided by Rubbish Removal Clapham.
